Family Mediation
What is Family Mediation?
Third Side Mediation family mediations mainly involve separating or separated couples. The aim is to help them ‘uncouple’ in a way which minimises the conflict between them. This is particularly important when the couple are parents. They will want to ensure, if possible, an amiable resolution of their dispute because this is in the best interests of the children.
How Can Mediation Help You?
Mediation not only avoids the prolonged adversarial process of court proceedings, but it provides the parties with much greater flexibility to reach a tailor made solution that meets the particular needs of the parties and the arrangements for children.
You can mediate without having a solicitor but Third Side Mediation does recommend that you consult with a family solicitor during the family mediation process.
Can I Access Mediation at any Point?
The parties can return in the future for a further mediation if they cannot agree on changes to the parenting plan or matters that were not covered in the original mediation.
Family mediation is a quicker, less costly and much fairer way to discuss and reach amicable agreements than the court process.
Can a Mediator Offer me Legal Advice?
A mediator is not allowed to offer either party legal advice so both parties will want to obtain legal advice about the information and valuations they need to obtain before they can enter into discussions about a fair settlement of the family’s finances, and about the fairness of the settlement.
What are the Benefits?
What are the Benefits of Family Mediation
According to the Ministry of Justice, the mediation route takes a quarter of the time that going through the divorce courts does and can be eight times cheaper. “All too often money is wasted on expensive and traumatic court hearings that can take far too long to resolve,” said Lord McNally, the family justice minister in January 2013. “And that is why we want to help people to use mediation, a quicker and simpler approach which brings better outcomes.”
Why You Should Consider Family Mediation?
Your solicitor will also arrange to have the mediation agreement made an Order of Court. If you have not already consulted a solicitor, the family mediator will discuss this with you. (Your lawyers will not be able to attend any family mediation meeting).
Whether you have been encouraged to consider mediation by the court or you just want to resolve a family dispute without the time, money and distraction involved in court proceedings, Third Side Mediation would be happy to help.
